2. Service Description

Sonacasts is an AI-powered podcast generation service that allows users to create podcasts based on text instructions. The Service uses artificial intelligence to generate:

• Podcast outlines and scripts
• Text-to-speech audio content
• Metadata and categorization

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

3. User Accounts and Eligibility

3.1 Account Creation

• You must be at least 13 years old to use this Service
• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service
• Non-payment of subscription fees
• Extended period of inactivity

4. Subscription Plans and Payments

4.1 Subscription Tiers

We offer multiple subscription tiers with different usage limits:

4.2 Billing

• Subscriptions are billed monthly based on your plan start date
• Payment is processed through our secure payment provider
• All fees are non-refundable unless required by law

• Failure to pay may result in service suspension or account termination

4.3 Usage Limits

• Usage limits are based on your subscription plan
• Limits reset monthly based on your billing cycle
• Exceeding limits will prevent further content playback until the next billing period or plan upgrade
• We reserve the right to adjust usage limits to manage costs and service quality

5. Content and Intellectual Property

5.1 User-Generated Instructions

You retain ownership of the instructions and topics you provide. By using our Service, you grant us a worldwide, non-exclusive license to use your instructions to generate content on your behalf.

5.2 AI-Generated Content

IMPORTANT: You are solely responsible for AI-generated content created through our Service.

• AI-generated podcasts are created based on your instructions
• We do not claim ownership of generated content
• We do not guarantee accuracy, quality, or originality of generated content
• You are responsible for reviewing and validating all generated content before use
• You assume all risks associated with the use of AI-generated content

5.3 Service Content

All aspects of the Service, including design, code, logos, and trademarks, are owned by Sonacasts and protected by intellectual property laws.

6. Content Deletion and Data Management

CRITICAL: We reserve the absolute right to delete, remove, or modify any content (including podcasts, audio files, scripts, and user data) at any time, for any reason, without prior notice or liability.

6.1 No Guarantee of Content Preservation

• We do NOT guarantee storage or availability of any content
• Content may be deleted to manage costs, storage limits, or service performance
• We are NOT responsible for any loss of content, data, or work product
• You MUST maintain your own backups of any content you wish to preserve
• Free tier content may be deleted after periods of inactivity
• Account termination results in permanent deletion of all associated content

6.2 Your Responsibility

It is YOUR responsibility to download and backup any content you wish to keep. We provide no warranty regarding content availability or longevity.

7. Copyright and DMCA

7.1 Copyright Infringement

We respect intellectual property rights. If you believe content on our Service infringes your copyright, please contact us immediately with:

• Description of the copyrighted work
• Location of the infringing content (URL or podcast ID)
• Your contact information
• A statement of good faith belief that the use is unauthorized
• A statement under penalty of perjury that the information is accurate
• Physical or electronic signature of the copyright owner or authorized agent

7.2 Takedown Process

Upon receiving a valid DMCA notice, we will:

• Promptly investigate the claim
• Remove or disable access to allegedly infringing content
• Notify the user who created the content
• Take appropriate action against repeat infringers

7.3 Counter-Notice

If you believe content was removed in error, you may submit a counter-notice following DMCA procedures.

8. Prohibited Uses

You agree NOT to use the Service to:

• Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringe on intellectual property rights of others
• Generate spam, misleading, or deceptive content
• Create content that promotes violence, discrimination, or hate speech
• Violate any applicable laws or regulations
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated systems to access the Service (except authorized APIs)
• Resell or redistribute the Service without authorization
• Impersonate others or misrepresent your affiliation

Violation of these prohibitions may result in immediate account termination and legal action.

9. Disclaimers and Limitations of Liability

9.1 Service "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

• We do not warrant that the Service will be uninterrupted, secure, or error-free
• We do not guarantee the accuracy, quality, or reliability of AI-generated content
• We are not responsible for content created by AI or user instructions
• We do not warrant that defects will be corrected

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SONACASTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or content
• Service interruptions or data loss
• Any damages arising from use or inability to use the Service
• Content generated by AI or based on user instructions
• Actions taken by third parties based on Service content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

9.3 Third-Party Services

We use third-party services (Google Cloud, payment processors, etc.). We are not responsible for the performance or policies of these third parties.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sonacasts and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Content you generate or instructions you provide
• Your violation of any third-party rights
• Any dispute between you and another user

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted. Material changes will be communicated via email or Service notification. Continued use of the Service after changes constitutes acceptance of modified Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of Finland, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in courts located in Finland.

You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
